Terms & Conditions:

The Accor Hotels' Gift Card is a stored value card (‘Card') issued to the purchaser (‘Customer') by AAPC Limited, trading as Accor Hospitality in its capacity as the issuer and manager of the Card (‘Manager'). The Card allows the Customer to load a dollar value onto the Card (‘Card Value') at the point of purchase of the Card.
The dollar value that is loaded onto the Card is a pre-payment. The Card should be looked after by the Customer like cash. It cannot be replaced if lost or stolen. No credit card, credit line, overdraft protection, or deposit account is associated with the Card.
Once it is loaded, the Card can then be used by the Customer or any person in possession of the Card (‘Holder') for future purchases of various goods and services, including accommodation (‘Services'), provided by hotels owned or managed by the Manager or a related body corporate and other hotels which are privately owned and have a marketing, management or franchise contract with the Manager or its related body corporate (‘each a Service Provider'). The dollar value of the Card cannot be redeemed or refunded for cash, nor can it be used to purchase another Card.
The Card can be used to redeem the Card Value principally towards pre-booked accommodation at publicly available rates (excluding Advantage Plus or Accor Vacation Club rates or benefits, or with contracted, negotiated or third party online rates). Any available remaining balance on the Card can then be used towards payment or part-payment of the Holder's room account, including in-house restaurant dining, or other incidental food and beverage charges, however no change will be given for the unused balance of the Card.
The Card expires 12 months after the date on which it is issued or activated by the Manger. Any unused value remaining on the Card on its expiry is not refundable.
The Card remains the property of the Manager at all times.


RESERVATIONS FOR SERVICES
Reservations at a Service Provider's hotel are subject to allocation and availability at the time of reservation.

Blackout dates may apply to publicly available rates, including school holidays and public holidays, or any special events periods. Room allocations fill quickly during special events, school holidays, public holidays and weekends and no guarantee can be given that an allocated room will be available at any Service Provider's hotel or for the days that a Holder may prefer.

All Card reservations for a Service Provider's hotel must be made via the Manager's central reservation department's, or individual hotel reservations' department ("Reservations") published telephone numbers and when making a reservation the Holder must advise Reservations they will be using a Card as payment method, and must quote the relevant Card number, and must also quote a credit card number.

CANCELLING A RESERVATION
If a Holder cancels its reservation, it must do so by contacting Reservations and advising of the relevant cancellation (‘Cancellation Notice'). If the Holder fails to give the Cancellation Notice as required before the date of arrival at the relevant Service Provider's hotel, pursuant to the reservation, the Service Provider will be entitled to deduct from the Card Value a cancellation fee determined in accordance with the Service Provider's usual policy.

REDEEMABLE SERVICES
Cards are valid in Australia, New Zealand and Fiji at participating Service Providers. A Card entitles the bearer to use the Card Value as a payment method for overnight accommodation at the hotel's 'Best Unrestricted Rate' at the time of booking, or any accessible publicly available rates at time of stay, at any participating Sofitel, Pullman, Grand Mercure, Novotel, Mercure, All Seasons or Ibis hotel in Australia, New Zealand and Fiji as listed in the Accor Gift Card Hotel Directory at the specified redemption rate advised by Reservations at each of the Service Providers.

Participating Service Providers may change from time to time and an up-to-date list may be obtained from the Gift Card co-ordinator appointed by the Manager ('Gift Card Co-ordinator') by request or online at the Manager's website being,www.accorgiftplus.com.au.

Where the Card has been used to acquire Services from a Service Provider that operates a hotel in New Zealand or Fiji, payment for those Services must be made by reducing the balance of the Card in accordance with the provisions of this Clause 3. If the amount that a Customer is required to pay to the Service Provider in New Zealand or Fijian dollars (as applicable) exceeds the Australian dollar value of the balance left on the Card, the Customer will be required to pay the difference in New Zealand or Fijian dollars (as applicable) to the Service Provider.

At the time payment is to be made to the Service Provider, the Service Provider will apply the exchange rate for converting the New Zealand or Fijian dollar price (as applicable) for those Services into Australian dollars ('Conversion Rate')

where:

Conversion Rate for NZD$1 or FJD$1 = Spot Rate (AUD$) x [100% + the Margin],

where:

Spot Rate means the spot rate obtained from www.oanda.com for the number of New Zealand or Fijian dollars (as applicable) represented by one Australian dollar; and

Margin means a margin determined by the Manager from time to time.
The AUD$ amount that is to be deducted from the Card balance is to be determined in accordance with the following formula:

AUD$ amount = NZD$ or FJD$ amount invoiced x Conversion Rate

The Card balance will then be reduced by the AUD$ amount in accordance with standard procedures for adjusting Card balances.

The Conversion Rate may differ from exchange rates available at the time a Customer makes a booking to stay at a New Zealand or Fijian hotel.

For the avoidance of doubt, the effect of clause 11 of these Terms and Conditions is that neither the Manager nor the Service Provider will be liable to the Customer where the AUD$ amount actually payable by the Customer to the Service Provider differs from the amount the Customer anticipated would be payable as a result of currency exchange rate fluctuations that occur between the time the Customer makes the booking and the time at which the amount is deducted from the Card balance.

NO ADDITIONAL VALUE CAN BE PUT ON THE CARD
Additional value cannot be added to a Card. All transactions are declined once a Card balance reaches zero.

Holders may check the balance of their Card at any time by request to the Gift Card Co-ordinator, or online at the Manager's website being, www.accorgiftplus.com.au.

Please note that there may be a delay between the time the Holder makes redemption and the time the redemption is reflected in the Gift Card balance shown. As a result the balance shown will not necessarily include all redemptions the Holder has made before its balance enquiry. The Holder agrees that notwithstanding what the Card balance is shown as, it is not entitled to redeem the Card for more than:

the nominated value of the Card; or
the actual remaining balance of the Card.
Any additional value sought by a Holder will require the purchase of a new Card and Card Value, in accordance with these Terms and Conditions. Any dollar value remaining on a Card may not be used to purchase an additional Card. The Holder may, however, redeem the Card Value, in exchange for Services, on two or more separate Cards.

ORDERS
Cards purchased directly from the Manager must be ordered by use of the current Accor Hotels Gift Card order form or any other written format, including any online form, that the Manager may direct from time to time ('Order Form').

PURCHASE
A Customer must purchase at least AUD$100 Card Value per Card, and thereafter in increments of AUD$25, but may not purchase more than AUD$1,000 Card Value for each Card. If more than AUD$1,000 Card Value is required, one or more additional Cards must be purchased.

Cards which have been purchased via fraudulent means or by way of stolen credit card details will be deemed to be purchased pursuant to an illegal transaction and that Card will be registered as stolen and the Card Value will not be honored by the Manager or any Service Provider.

DISPATCH AND PAYMENT
Cards ordered directly from the Manager will only be dispatched when full payment is received by the Manager (including any service or delivery charges) in accordance with these Terms and Conditions. Refunds and exchanges are not available after full payment is received. All stated prices are in Australian dollars and inclusive of GST. GST and any other taxes, charges, fees or duties that are, or may be, levied on the Services or other goods purchased from a Service Provider must be paid by the Holder at the time that it uses the Card to purchase the Services and/or goods..

Payment for a Card may be made by any of the following means:

cheque payable to AAPC Limited, trading as Accor Hospitality or Accor Gift Cards, allowing 5 business days for clearance;
credit card (Amex, Diners, MasterCard, Visa) for email or phone orders.
Postage and courier charges apply as follows:

A charge of AUD$5.50 per individual Card order (up to 20 cards per order) or AUD$27.50 for bulk orders (21 Cards or more) will apply and is payable at the same time as payment is made and submitted with an Order Form for purchasing a Card. This charge is subject to change. For larger quantities, please contact the Gift Card Co-ordinator to determine postage charges.

Orders will be dispatched within 7 business days (that being any business day upon which banks are open for business in both Sydney and Melbourne) of receipt of the Order Form and payment in full. Valid Order Forms and payment in full must be received by 10am on the day of receipt if the Order Form is to be included in the 7 Business Day period. If payment is made by way of cheque, an additional 5 Business Days must be allowed prior to dispatch of an Order.

DELIVERY
Cards ordered directly from the Manager will be delivered by Express Post or courier, as arranged at time of Card purchase. Neither the Manager nor any Service Provider will be held liable for any loss suffered as a result of a Card being lost or damaged in the normal delivery process. Upon delivery of the Card to the Customer, the Customer accepts full responsibility for the safekeeping of the Card.

If an order has not arrived at the Customer's delivery location within 13 days of the date it is sent, the Manager may cancel and replace such order; provided the Customer submits to the Manager a properly completed Affidavit of Lost Card within 60 days of the date the Card was sent to the Customer. Upon receipt of a correctly completed and sworn affidavit and provided a balance remains on the Card from such order, the Manager will initiate a review procedure. The Card may or may not be replaced at the Manager's sole discretion, depending on the outcome of the review. The Manager will not in any circumstance replace a Card after it has been received by the Customer.

The Customer is responsible for informing the Manager of the correct contact names and addresses for invoicing the Customer, and for delivery. Changes to orders must be made in writing and forwarded by mail, email or fax to the Gift Card Co-ordinator. Changes made via telephone will not be accepted. Changes to orders will only be possible prior to an Order Form being processed by the Gift Card Co-ordinator.

EXPIRY DATE
The date of issue of each Card will be recorded by the retailer or the Manager (as applicable). All Cards will be valid for twelve months only from the date of issue, or as per the pre-printed date of expiry ("Validity Period"), as detailed on the reverse of each Card. The Card Value must be used during the Validity Period. Following expiry of the Validity Period the Card will expire and any unused balance will not be refunded. After the Card has expired it is no longer valid and all transactions will be declined.

Holders may check the Validity Period of their card at any time by request to the Gift Card Co-ordinator, or online at the Manager's website being, www.accorgiftplus.com.au.

LIABILITY FOR LOST/STOLEN CARDS
Holders are advised to protect their Card as they would cash. Lost or stolen Cards will not be replaced.

Neither the Manager nor the Service Providers accept any responsibility for lost or stolen Cards or their unauthorised use.

Partial unused Card Value on a lost or stolen Card will not be refunded or exchanged for cash or credit.

Copies of Cards will not be accepted. Cards will be deemed void if altered in any way. The Service Provider may refuse a damaged Card or any Card it reasonably suspects has been altered, stolen or is not a valid Card.

LIABILITY
To the extent permitted by law, the Manager and the Service Providers make no representations, warranties or conditions of any kind, express or implied, with respect to the Card. The Manager does not represent or warrant that the Card will always be accessible or accepted.

Neither a Service Provider nor the Manager are required to carry out any of the obligations referred to in these Terms and Conditions if it is not reasonably practical for them to do so because of an event outside of their control.

To the extent permitted by law, in the event that the Manager or the Service Providers are found liable to the Customer or the Holder, the Customer or Holder shall only be entitled to recover actual and direct damages and such damages shall not exceed the last balance held on the Holder's Card.

The Manager and the Service Providers shall have no liability for any incidental, indirect or consequential damages (including without limitation loss of profit, revenue and use) arising out of or in any way connected with use of a Card.

The Customer and the Holder both indemnify the Manager and any relevant Service Provider against any loss, cost, claim or liability the Manager or the Service Provider might suffer arising out of or in any way connected with the Customer's or any Holder's use of a Card or a breach of these Terms and Conditions.

The Manager may cancel a Card at its discretion if the Customer or any Holder breaches any of these Terms and Conditions.

Where the Holder of the Card is not the Customer, these Terms and Conditions are not intended to create an obligation or any other rights enforceable by the Holder against the Manager or any Service Provider.

Certain legislation, including the Trade Practices Act 1974 (Cth), may imply warranties or conditions or impose obligations upon the Manager and the Service Providers which cannot be excluded, restricted or modified or cannot be excluded, restricted or modified except to a limited extent. These Terms and Conditions must be read subject to these statutory provisions.

If these statutory provisions apply, to the extent to which the Manager and the Service Providers are able to do so, their liability under those provisions will be limited, at their option to:

in the case of goods, the replacement of the goods or the supply of equivalent goods; the repair of the goods; the payment of the cost of replacing the goods or of acquiring equivalent goods; or the payment of the cost of having the goods repaired; or
in the case of services, the supplying of the services again; or the payment of the cost of having the services supplied again.

DISPUTE
In the event of any problem or dispute in relation to the Card or any Service purchased with the Card, the Manager may authorise the Gift Card Co-ordinator to consult with the Holder in an effort to make alternative arrangements but this does not create an obligation on the Manager to do so.

COMPLAINTS HANDLING
If a Customer or Holder believes they have been charged in error or has any other dispute about their Card, the Customer or Holder must contact the Gift Card Co-ordinator and provide details of the dispute or error.

The Gift Card Co-ordinator will investigate the matter in accordance with the Manager's Complaints Handling Procedures, and in conjunction with the Manager's Customer Services Manager.

The Customer or Holder must provide the Gift Card Co-ordinator with all details requested by the Gift Card Co-ordinator acting reasonably, including their name, account details, Card number, and location of the transaction in dispute, date and time of transaction and contact details.

The Gift Card Co-ordinator will make every reasonable effort to notify the Customer or Holder within 10 business days from the date the disputed charge(s) are reported as to the outcome of its investigation. If it is determined that an error has occurred, the Holder's account will be re-credited.

If the Customer or Holder is not happy with the decision of the Gift Card Co-ordinator, the Customer or Holder may apply to the relevant government authority for further investigation.

NOTICE OF MATERIAL CHANGES TO TERMS AND CONDITIONS
The Manager will give Customers 30 days' written notice of any material changes to these Terms and Conditions of the Card, via its website at www.accorgiftcards.com.au, notwithstanding that it is entirely within the Manager's discretion to make such changes.

CUSTOMER ACCESS TO THEIR DETAILS
Holders can obtain an electronic record of their Card balance, Validity Period and transaction history from time to time, within 5 business days of making a request to obtain these details, or via the Manager's website at www.accorgiftcards.com.au. The Manager will not charge for Holders to have this access to their details.

The Manager reserves the right to limit a transaction record to the 3 month period immediately preceding the request.

ACCEPTANCE OF TERMS
The purchase of the Card by a Customer from the Manager or a retailer, and any subsequent use of the Card by its Holder constitutes acceptance by the Customer and Holder of these Terms and Conditions.

RIGHT TO CHANGE, MODIFY OR AMEND
Subject to Clause 14, the Manager reserves the right to modify, change or amend these Terms and Conditions at any time without notice.

PRIVACY AND THE CUSTOMER'S CONSENT
In order to provide the Customer with a broad range of information in relation to tourism, hospitality and services and to assist in delivering a better service to the Customer, the Accor Group (including the Manager) will retain the information the Customer has provided.

Information collected by the Manager about the Customer or the Holder (as the case may be) may be "personal information" for the purposes of the Privacy Act 1998. The Customer and any Holder both agree to the collection and use of this personal information and the disclosure of such information to the Manager's agents for the purpose of operating and marketing the Cards.

Information can be disclosed to the Service Provider and any of the Manager's agents, if:

the Customer consents in writing;
the Manager considers that disclosure is necessary to enable a Card to be issued, redeemed or otherwise processed, or to enable the Manager, the Service Provider and any of the Manager's agents to comply with their obligations under these Terms and Conditions; or
the Manager considers that the Customer or the Holder may have been involved in fraudulent activities in relation to a participating company, in which case the Manager may also cancel the Card at its discretion.
The Customer agrees that the Manager can disclose its personal information to the Holder. The Customer and the Holder both have the right to request access to, and correction of, this personal information. 5. Gift Cards expire 24 months from the date of issue and will not be reissued once expired. Any balance remaining on a Gift Card will not be redeemable for use once expired.

6. On presentation of a Gift Card to a Harvey Norman Franchisee in unaltered form, and without any fraudulent use, the Issuer will procure the Harvey Norman Franchisee to provide credit to the bearer up to the value or balance of the Gift Card as identified on the System, against the purchase price due to the Harvey Norman Franchisee. If the purchase exceeds the value or balance of the Gift Card, the bearer must pay the excess using another payment method. No change will be given and any balance of the Gift Card may only be used in whole or part against future purchases.

7. Gift Card balance, transaction history and expiry date may be verified in any Harvey Norman store.

8. "Access PIN" means the 4-digit Access PIN printed on the back of the Gift Card;

"Card Number" means the 19-digit number that appears on the back of your Gift Card;

"Gift Card" means the Gift Card that you have purchased from us for use in the participating retailer's store (including but not limited to Supercheap Auto, BCF Boating Camping Fishing, Goldcross Cycles and Ray's Outdoors).

"Remaining Card Value" means, at any time, that portion of the initial value loaded onto your Gift Card which is unspent and can be accessed by using the Gift Card in accordance with these Terms of Use;

"we", "us" or "our" means a reference to "Super Retail Group Services Pty Ltd A.C.N. 093 167 107";

"you" or "your" means a reference to the person who is in possession of the Gift Card at the relevant time for the purposes of these Terms of Use, or who authorises another person to do something with or to the Gift Card on their behalf.

1.Introduction
1.1.This document contains the full set of terms and conditions governing the use of your Gift Card.

1.3.Please note that separate terms and conditions govern the purchase of your gift card - ensure that you consult these when making a gift card purchase, they are available on the participating retailer's website (e.g. www.supercheapauto.com, www.bcf.com.au, www.raysoutdoors.com.au and www.goldcross.com.au).
2.Accepting the Gift Card and agreeing to these Terms of Use
2.1.By purchasing, redeeming or attempting to redeem a Gift Card, you:
2.1.1.accept and agree to be bound by these Terms of Use; and
2.1.2.acknowledge that you have read and understood our Privacy Policy as referred to in clause 7 below (or available by calling 1800 285 410).
3.Transactions made using the Gift Card
3.1.How and where you can use the Gift Card:
3.1.1.Purchases with your Gift Card:
3.1.1.1.You may purchase goods from the participating retailer stated on the Gift Card by selecting the goods and taking them to the point of sale operator in the participating retailer's stores. The operator will instruct you to swipe your card in the pin pad, and then enter the Access PIN into the pin pad. The transaction will be completed when the balance has reduced on your Gift Card. No change will be given: any remaining balance on the card can only be used in whole or part against future purchases.
3.1.2.You acknowledge that the Gift Card may not be used:
3.1.2.1.for online purchases through the websites of the participating retailer stated on the Gift Card,;
3.1.2.2.to pay a store or credit account;
3.1.2.3.to purchase goods or services that the participating retailer is not permitted to supply to you by law in the location the sale is to take place (for example, a retailer cannot by law sell alcohol to you if you are under 18 years of age and there are age restrictions on weapons and volatile substances that vary between states);
3.1.2.4.to purchase goods or services that are not permitted to be supplied to you under the participating retailer's company policy in the location the sale is to take place - for example spray paint will not be sold to persons under 18 - these sale restriction policies vary between stores; please observe the available signage or ask a store manager for any sale restrictions which apply.
3.1.2.5.for purchases by email, phone or fax.
3.1.2.6.The Gift Cards that are purchased directly from www.supergifts.com.au in the same transaction will be pre-loaded and activated at the same time/concurrently.
3.2.You agree that we can reduce the Remaining Card Value by the value of all purchases of goods and services that are authorised by you. Transactions are authorised by you by:
3.2.1.swiping your Gift Card and entering your Access PIN, or allowing an operator or other person to do so, at an electronic point of sale terminal at a participating retailer; or
3.2.2.giving a participating retailer details of the Gift Card and authorising the transaction in some other way approved by that retailer.
3.3.When you authorise a transaction:
3.3.1.you are confirming that the transaction correctly represents the purchase price of the goods or services obtained; and
3.3.2.you are agreeing to pay the amount of that transaction by the reduction of the Remaining Card Value.
3.4.Purchases exceeding the Gift Card value:
3.4.1.Your Gift Card may only be used to make purchases up to the Remaining Card Value. If you wish to make a purchase for an amount that exceeds the Remaining Card Value, you must pay the excess using another payment method.
3.5.No cash advances:
3.5.1.You cannot obtain any cash advance with your Gift Card or redeem your Gift Card for cash.
3.6.Validity and expiry of Gift Cards:
3.6.1.Your Gift Card will be valid for use for one year from the date of issue or as otherwise indicated to you by us. Any balance that remains on a Gift Card will not be available for use after the card's expiry date.
3.6.2.To check the expiry date of your Gift Card, call 1800 285 410. You must have the 19 digit card number and serial number with you.
3.7.Re-issue of faulty or damaged Gift Cards:
3.7.1.Faulty or damaged Gift Cards shall not be replaced by Ray's Outdoors unless the Gift Cards are proven to be faulty or damaged as a result of the production process or otherwise due to the fault of Ray's Outdoors, its agents or contractors or a participating retailer.
3.8.Destruction of Gift Card with no value:
3.8.1.Once the Remaining Card Value is completely used, please destroy your card by cutting it in half diagonally. Your Gift Card cannot be reloaded.
3.9.Lost or stolen Gift Cards:
3.9.1.Treat your Gift Card like cash. Lost or stolen cards will not be replaced or refunded.
3.10.Checking your Gift Card balance and transaction history:
3.10.1.You can check your card balance, expiry date and transaction history by calling 1800 285 410. Please have your 19 digit card number and serial number ready.
3.10.2.For balance enquiries online, you will be required to enter both the Card Number and Access PIN on your Gift Card prior to getting access to the card information.
3.11.Can I exchange my Gift Card?
3.11.1.You cannot exchange your Gift Card for a different brand, denomination or type of Gift Card or for another tender, cash or discount.
4.Your Gift Card, your responsibility
4.1.You are responsible for the use and safety of your Gift Card. You are liable for all transactions on your Gift Card, except to the extent to which there has been fraud or negligence by us or by any of our employees.
5.Changes to Terms of Use
5.1.We reserve the right to change any of the terms contained in these Terms of Use at any time where the change is required, including changes:
5.1.1.To add or remove participating retailers, retailers and/or where the Gift Card may be redeemed;
5.1.2.To add or remove goods or services which may be purchased with the Gift Card;
5.1.3.For infrastructural, systems, administrative or operational reasons or to prevent the occurrence of fraud or other unlawful or unacceptable conduct;
5.1.4.To comply with any contract, law, regulation or statute or order or judgment of any court, tribunal or other body having competent jurisdiction; or
5.1.5.Where we, acting reasonably, consider that it will not be to your detriment.

6.1.1.Generally under copyright laws the owner of the copyright in images or photographs is the person who created the images or took the photographs. You represent and warrant to us that you are the owner of the copyright or have the express permission of the owner of the copyright in the images or photographs which you submit to us.
6.1.2.We claim no ownership rights in any photographs and materials you submit to us. You grant to us and to our third party service providers, a perpetual, worldwide, non-exclusive, transferable, royalty-free, copyright licence to copy, reproduce, display, modify, adapt or alter, transmit, and distribute your photographs and materials for the purpose of allowing us to provide you with the Products you have requested including but not limited to fulfilling your Order.
6.1.3.Provided we comply with our obligations under these Terms and Conditions, you warrant that you will not make any claim against us or our third party service suppliers, for any use, publication or copying of the photographs and materials you have submitted to us and you waive all rights of action or other claims you may have now or in the future against us in respect of any such use, publication or copying.
6.2.Your Infringement of Copyright
6.2.1.We respect the intellectual property rights of others. If we receive a complaint alleging that you have infringed copyright, we will refer the complaint to you for resolution. It will be your responsibility to resolve any such complaint. Should you not resolve the complaint satisfactorily and advise us, in writing, of the resolution within seven (7) days of the date we refer the complaint to you (the "Referral Date"), we reserve the right, in our absolute discretion, to suspend your Order until such time as the complaint is resolved. If you do not notify us within thirty (30) days of the Referral Date that the complaint has been satisfactorily resolved, we reserve the right, in our absolute discretion, to terminate your Order.
6.2.2.If any person makes any claim against us or our third party service suppliers, claiming that any of the photographs and materials you submit to us, or any use of them, infringes any copyright, or other intellectual property or moral right of any person, company or entity, you indemnify us and our third party service providers against all costs, claims, loss, damage, demands and expenses (including all reasonable legal costs, fees and expenses) arising directly or indirectly out of such claim.

8.Errors and complaints
8.1.Gift Cards:
8.1.1.If you have reason to believe that an error has occurred in relation to your Gift Card, you should call 1800 285 410.
8.2.Goods or services:
8.2.1.Any complaints about goods or services purchased with a Gift Card must be resolved directly with the store concerned or the manufacturer of the goods.
9.Force majeure
9.1.To the extent permitted by law, we will not be liable to you for any loss or damage (whether direct or consequential), nor be in default under these Terms of Use, for failure to observe or perform any of our obligations under these Terms of Use for any reason or cause which could not, with reasonable diligence, be controlled or prevented. These causes include acts of God, acts of nature, acts or omissions of government or their agencies, strikes or other industrial action, fire, flood, storm, riots, power shortages or failures, sudden and unexpected system failure or disruption by war or sabotage, and other acts or omissions of third parties.
10.Applicable law
10.1.These Terms of Use are to be construed and enforced in accordance with the laws of Queensland, Australia. Any dispute arising from your receipt or use of a Gift Card is exclusively subject to the jurisdiction of the courts of Queensland, Australia (including the Federal Court of Australia, Queensland Registry).

Definitions & Terms Used

"Program" means the Rydges Gift Card Program, as governed in accordance with these Terms and Conditions;

Rydges Gift Card means a ‘smart chipped' card device featuring a stored dollar value (Gift Dollars) issued to the Customer containing a pre-determined dollar value ranging from $100 to $500 Dollars in both Australian and New Zealand Dollars.

"Promoter" means Rydges Hotels & Resorts in its capacity as manager of Rydges Gift Card program in conjunction via its authorised fulfilment agencies.

"Program Accommodation and Food & Beverage" means principally hotel accommodation and meals and/or bar expenses (if applicable) provided by Participating Hotels in the Program which Customers may redeem using their Gift Card dollars.

"Participating Hotels" means those hotels listed at www.rydges.com & www.experiencethis.com.au as participating as redemption hotels for the Program.

"Purchaser" means a customer that orders and purchases a Rydges Gift Card from the Promoter pursuant to the Program on behalf of a Customer

"Customer" means a customer who has been issued with a Rydges Gift Card by either the Promoter (Rydges Hotels & Resorts) or Purchaser pursuant to the Program and is the specified holder of the Rydges Gift Card.

"Gift Dollars" means the pre-determined nominated dollar value which is pre-loaded in either Australian OR New Zealand Dollars on to the Rydges Gift Card at the time of issue. The amount & currency of issue of Gift Dollars pre-loaded on each Rydges Gift Card is specified on the back of the card. The card is to be treated with the same care and security as cash. If lost or stolen, Rydges Gift Card cannot be replaced.

"experiencethis" and www.experiencethis.com.au means the retail & online voucher store (a wholly owned subsidiary of Amalgamated Holdings) & responsible for issuance, despatch, delivery and dispute resolution of Rydges Gift Cards.

Smart Visit Solutions means the technology and program partner responsible for issuance, despatch, delivery and dispute resolution of Rydges Gift Cards.

The card remains the property of the promoter

1 Use of Rydges Gift Card at Participating Hotels

1.a The Rydges Gift Card is used primarily to redeem "Gift Dollars" towards Program Accommodation and Food & Beverage products at Participating Hotels. Customers may make an accommodation reservation at a Participating Hotel by either calling the Central Reservations department 1300 857 922 (Australia) or 0800 446 187 (New Zealand) or directly online via www.rydges.com. Accommodation reservations require a valid credit card number to guarantee & confirm the reservation. Upon check-in the Customer should present the original Rydges Gift Card and inform staff if they wish to redeem the Gift Dollars in exchange for Program Accommodation and or Food & Beverage. Upon check-out the credit card advice will be destroyed if the Customer redeems the final account utilising the Gift Dollars stored on the their Rydges Gift Card.

Rydges Gift Cards are sold $100, $250 & $500 Australian or New Zealand dollars denominations. They can be used for redemption in local currency only. Rydges Gift Cards issued in Australian Dollars can ONLY be used at participating hotels located in Australia Rydges Gift Cards issued in New Zealand Dollars can ONLY be used at participating hotels located in New Zealand.

1.b Copies of Rydges Gift Card will not be accepted. Rydges Gift Card's will be deemed void if altered in any way. A Participating Hotel may refuse to accept a damaged Rydges Gift Card or any Rydges Gift Card if it reasonably suspects the card has been altered, stolen, defaced or is being used in a criminal or fraudulent manner.

1.c Rydges Gift Card's and associate Gift Dollars, or Program Accommodation and Food & Beverage bought with them, are not redeemable for cash or credit card transactions, hotel line of credit nor hotel accounts.

If there are sufficient Gift Dollars on a Customer's Rydges Gift Card to redeem the selected Program Accommodation and Food & Beverage in full, the Rydges Gift Card dollars cannot be used in conjunction with part-cash payments. If there are insufficient Gift Dollars on the Customer's Rydges Gift Card's to redeem the selected Program Accommodation and Food & Beverage in full, then the balance may be purchased by the Customer with a cash or credit card payment.

1.d Participating Hotels may change over time (as determined by the Promoter in its absolute discretion). A list of current participating hotels can be found online at Rydges Gift Card section located at www.rydges.com. Participating Hotels listed are correct at the time of the publication and it remains the sole responsibility of a Customer to check prior to making the reservation if a particular hotel is a Participating Hotel in the Program prior to making the reservation.

Capitol Square Hotel Sydney, Thredbo Alpine Hotel and all Rydges hotels located in Fiji, United Arab Emirates, Qatar, and United Kingdom are NON Participating Hotels

1.e Rydges Gift Card Dollars can be used to redeem Program Accommodation and Food & Beverage, meals, bar tabs, room service and other services in local currency that can be charged to a guest account folio at a Participating Hotels. Any other travel costs and expenses incurred are the sole responsibility of the Customer.

1.f Rydges Gift Cards may not be "topped up" with additional Gift Dollars to those already pre-loaded onto the Rydges Gift Card at the point of issue. Additional Gift Dollars will require the purchase of a new Rydges Gift Card and associate Gift Dollars, in accordance with these Terms and Conditions. A Customer can redeem Gift Dollars; in exchange for Program Accommodation and Food & Beverage from multiple (two or more) Rydges Gift Card's at the same time.

1.g Reservations at Participating Hotels remain subject to availability at the time of booking. No guarantee can be given that a particular room will be available at any Participating Hotel on or for the days that the individual Customer may prefer.

1.h Customers can cancel a reservation; however they must do so by contacting the applicable hotel directly and advising them of the cancellation ("Cancellation Notice"). If the Customer fails to provide Cancellation Notice by 6pm on the day before the scheduled date of arrival at the relevant Participating Hotel, pursuant to the reservation, a cancellation fee, in lieu one night's accommodation at the reservation rate will be charged.

1.i Rydges Gift Cards cannot be brought & re-sold by via 3rd party auction sites. Any Rydges Gift Cards's found for sale on such sites will be deemed null and void and electronically cancelled

2 Purchase & Payment of Rydges Gift Cards

2.a Purchase of a Rydges Gift Card's can conducted online at www.rydges.com. Online orders must be purchased using a valid credit card.

2.b Rydges Gift Cards are dispatched when full payment (of the amount equating to the number of Gift Dollars pre-loaded on the card, in each case) is received by the Promoter (including any service or postage charges) in accordance with these Terms and Conditions. Refunds and exchanges are not available after full payment is received.

2.c Orders are dispatched within 5 business days of receipt of the order and payment in full. Currently accepted credit cards include Visa, MasterCard American Express & Diners Club.

2.d Rydges Gift Cards are issued in Australian Dollars OR New Zeland dollars only. For exclusive use in the country of issue.

2.e All prices are inclusive of GST unless otherwise stated. Any other taxes, charges, fees or duties that are, or may be levied on such prices or Program Accommodation and Food & Beverage must be paid for by the Purchaser unless otherwise stated.

2.f Courier, Mail and a order handling costs will apply. A minimum charge of $9.95 AUD per order is applicable and is payable at the same time as payment is made and submitted with an order for purchasing a Rydges Gift Cards.

2.g The Promoter is not responsible for inaccurate or incorrect information supplied during the ordering process, either caused Customer or Purchaser or by any of the related Information Technology infrastructure/platform nor programming associated with or used in this Program, or by any technical error that may occur in the course of the administration of this. The Promoter assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorised access to or alteration of orders and/or other information submitted in connection with this Program.

3 Delivery of Rydges Gift Cards

3.a Rydges Gift Cards will be delivered by post/courier when ordered via www.rydges.com The Promoter and any Participating Hotel will not be held liable for any loss as a result of a Rydges Gift Cards being lost, stolen or damaged once dispatched for delivery.

3.b The Purchaser is solely responsible for correctly informing the Promoter of their contact details and address(es) to allow for timely delivery of the Rydges Gift Cards'. Changes to orders can only be accepted in writing and forwarded by mail, email or facsimile to the Rydges Gift Card Manager at giftcards@rydges.com. No changes made via telephone will be accepted. Changes to orders will only be possible prior to an order being processed by experiencethis.com

4 Expiry Date of Cards

4.a All Rydges Gift Cards are valid for 12 months from the date of issue ("Validity Period").

4.b If the Customer does not fully redeem all of the Gift Dollars on a Rydges Gift Card for Program Accommodation and Food & Beverage within the Validity Period, they may apply for an extension of the Validity Period by making written application to Rydges Gift Card Manager at giftcards@rydges.com no later than 1 month prior to the expiry of the Validity Period as indicated upon the Rydges Gift Card.

Application for extensions must clearly contain the following information:

(i) why an extension to the Rydges Gift Card is being required
(ii) the identification number of the Rydges Gift Card and
(iii) the expiry date of the Rydges Gift Card.

And post the written application to RYDGES Gift Card Manager

The Promoter reserves the right to grant a Customer an extension of the Validity Period at its absolute discretion but is not bound to do.

4.c If an extension to the Validity Period is granted by the Promoter, it remains the Customer duty to return the Rydges Gift Card to the Rydges Gift Card Manager at experiencethis.com with an administration fee of $50.00 (AU or NZ) per Rydges Gift Card. The Rydges Gift Card Manager will then arrange for a new Rydges Gift Card to be issued in replacement of the old one (with remaining balance of the Gift Dollars on the old card transferred to the new Rydges Gift Card) and the extended Validity Period will be recorded on the new Rydges Gift Card.


5 Stolen or Lost Cards

5.a In the event of a Rydges Gift Card being lost or stolen a Customer is not entitled to a cash refund of any unused 'Gift Dollars'. They should contact the Rydges Gift Card Manager at giftcards@rydges.com directly.

5.b The Promoter will not accept any responsibility for stolen, lost, damaged or wilfully defaced Rydges Gift Cards or for any un-authorised or fraudulent use thereof.

6 Liability

6.a To the extent permitted by law, the Promoter, its authorised agents and Participating Hotels make no representations, warranties or conditions of any kind, express or implied with respect to the Rydges Gift Card. The Promoter does not represent or warrant that a Rydges Gift Card will always be accessible or accepted.

To the extent permitted by law, in the event that the Promoter, its authorised agents and Participating Hotels are found liable to the Purchaser or Customer, they shall only be entitled to recover actual and direct damages and such damages shall not exceed the last balance held on that Customers Rydges Gift Card.

The Promoter, its authorised agents and Participating Hotels shall have no liability for any incidental, indirect or consequential damages arising out of or in any way connected with the use of a Rydges Gift Card.

Certain legislation, including the Trade Practices Act 1974 (Cth), may imply warranties or conditions or impose obligations upon the Manager, the Service Providers and the Attractions which cannot be excluded, restricted or modified or cannot be excluded, restricted or modified except to a limited extent. This agreement must be read subject to these statutory provisions.

If these statutory provisions apply, to the extent to which the Promoter, its authorised agents and Participating Hotels are able to do so, their liability under those provisions will be limited, at their option to:

(i) in the case of goods, the replacement of the goods or the supply of equivalent goods, the repair of the goods; the payment of the costs of replacing the goods or of acquiring equivalent goods; or the payment of having the goods repaired; or
(ii) in the case of services, the supplying of the services again; or the payment of having the services supplied again.

7 Dispute

7.a In the event of any dispute or issue arising in regards to the Rydges Gift Card or any Program Accommodation and Food & Beverage purchased with the Rydges Gift Card, or any other dispute in relation to any matter concerning the conduct or administration of the Program, the Promoter may authorise the Rydges Gift Card Manager to consult with the Customer or Purchaser (as the case may be) in order to resolve the dispute or issue, but this does not create an obligation on the Promoter to do so.

7.b Any and all decisions of the Promoter in relation to any aspect of this Program will be final and binding on the Customer and Purchaser.

8 Acceptance of Terms

8.a The submission or electronic receipt of an order is deemed to constitute acceptance of these Terms and Conditions.

9 Right to Modify, Alter and Amend

9.a These Terms and Conditions are subject to the specific terms and conditions of each Participating Hotel and all applicable laws in the country where the Rydges Gift Card's are purchased.

9.b The Promoter reserves the right to modify, change and alter any Terms and Conditions in its absolute discretion at any time without notice and without liability. The Promoter also reserves the right to terminate the Program in whole or in part in its absolute discretion at any time without notice and without liability. Any and all 'live' Rydges Gift Card within the marketplace will be honoured until the end of their Validity Period (12 months of card being issued).

10 Permission

10.a In line with Rydges Hotels & Resorts Privacy Policy, the Promoter may retain information provided in connection with the Program. Details about Privacy Policy and how such information is treated can be found at www.ahl.com.au

What is a Gift Card?
A gift card is a plastic card which contains a pre-purchased value ($ amount) that is redeemable in Smiggle Stores across Australia and New Zealand, or via our online shop.

How do I purchase one?
Purchasing a gift card is easy, simply visit your nearest Smiggle store or purchase one online here

In store
You can purchase a gift card in any Smiggle store for any value between $5 and $1,000. Cards are active once your purchase has been completed through the point of sale in-store.

Important note: gift cards purchased in Singapore stores can only be redeemed in Smiggle stores within Singapore. They cannot be redeemed online or in Smiggle stores in other countries.

You cannot purchase a gift card as part of a lay-by sale. Gift card value cannot be reloaded.

Online
You must be a registered Smiggle Online member to purchase a gift card through our on-line store. Simply visit our website, create your own online account and select the gift card denomination you wish to purchase.

Once you have added the gift card to your shopping bag, proceed through to the checkout, inform us of the lucky recipient's details and the gift card will be posted within 2 to 3 business days.

You can purchase items from within our on-line store and combine a gift card with the purchase. The items in your order will be sent to you and each gift card will be sent out individually to the recipient of your choice at no cost via Australia Post.

The value of gift cards purchased online is in $AUD, but can also be redeemed within Smiggle stores in both Australia and New Zealand.

Important note: gift cards purchased online are unable to be redeemed in Smiggle stores within Singapore.

Where can I use my Gift Card?
Aus + NZ Customers
You may use your gift card at any Smiggle store within Australia or New Zealand as well as to shop online at www.smiggle.com.au

Singapore Customers
If your gift card was purchased in Singapore, it can only be redeemed in Smiggle stores within Singapore. They cannot be redeemed online or in Smiggle stores in other countries.

However, if your card was purchased online, you may use it to shop online at www.smiggle.com.au; your card is not valid for use within Singapore.

How do I use my Gift Card?
You can purchase any item in store or online using your gift card. You can use your gift card as many times as you want until the balance reaches zero.

In Store:
Just give the gift card to the sales assistant when making your purchase. You will need to scratch the panel covering the access code and enter this number on the pin pad when prompted. Our Smigglers will help you do this. Once the transaction has been completed your gift card balance will be reduced by the purchase amount

Online:
When you have finalised the items in your Shopping Bag and proceed through the Checkout, you will need to enter the Gift Card number as well as the Access Code into the Gift Card field as provided. Then just click 'Add Method' review the details and continue through to submit your order.

Important note: gift cards purchased online can not be redeemed within stores in Singapore, and all gift cards purchased from Smiggle stores in Singapore are not able to be redeemed online.

What if I don't use the full amount on my card?
We will not refund cash for any unused gift card amount; this amount stays on your card for future use.

When does it expire?
Gift cards are valid for 12 months from the date of purchase. The expiry date can be found on your receipt, on the back of the gift card or online.

Can I check the balance?
Every time you make a purchase in-store the receipt will show you the previous balance, transaction value and remaining balance.

You can also view your gift card balance online at any time, or just head to your nearest Smiggle store.

If your card has been used online, you can check your transaction history online or by contacting us - in Australia call 1800 612 236 and in New Zealand call 0800 023 522

Important note, Singapore residents are unable to check their gift card balance online, please head to your nearest Smiggle store and ask one of our Smigglers to check it for you.
